1.Agreement to these terms

These Terms and Conditions govern your use of Dataluk Projects (the “Service”), including submitting a project for review and paying the processing fee. By submitting a project or completing a payment, you confirm that you have read, understood and agreed to these terms. If you do not agree, do not submit a project or make a payment.

2.What the Service provides

The Service accepts project submissions and produces an AI-generated viability report covering areas such as innovation, market viability, technical feasibility, impact potential and clarity, together with a recommendation.

The report is informational and automated. It is not professional, legal, financial, investment or technical advice, and it is not a guarantee about your project's prospects. You remain solely responsible for any decision you take on the basis of a report.

3.Processing fee

Where a processing fee is in force, it is displayed to you in full at checkout before any payment is taken, and you must actively acknowledge the fee disclosure before the payment can begin. The amount shown at checkout is the amount you will be charged.

The processing fee is a fee for the review and assessment service itself. It is not a payment for a specific score, outcome, recommendation, publication, endorsement, award, grant or funding, and paying it does not guarantee any of those things.

We may change or remove the fee at any time. A change never affects a payment that has already been started: the amount and terms shown to you at checkout are snapshotted and honoured for that transaction.

4.Refunds

The processing fee is non-refundable once your submission has entered processing, except as required by law or as expressly stated in these terms.

Notwithstanding the above, we will refund the fee where:

  • you were charged more than once for the same submission (we refund the duplicate charges);
  • you were charged but we never began processing your submission — for example a technical fault on our side prevented the assessment from being produced; or
  • a refund is required under applicable consumer-protection law.

To request a refund under this clause, contact us with your payment reference within 30 days of the charge. Approved refunds are returned to the original payment method and may take up to 10 business days to appear, depending on your bank.

5.Payment processing

Payments are processed by Paystack. Your card and banking details are entered on Paystack's systems and are never seen or stored by us. We store only the transaction reference, amount, currency, status, channel and the email address you gave for the receipt. Your use of Paystack is also subject to Paystack's own terms.

We record which version of these terms you acknowledged and when, so that both parties have a clear record of what was agreed.

6.Your submission

By submitting a project you confirm that:

  • the submission is your own work, or you have the right to submit it;
  • the information you provide is accurate and not misleading;
  • the submission does not infringe anyone else's intellectual property, confidentiality or other rights; and
  • the submission is not unlawful, deceptive, or a duplicate of a submission already on the Service.

You keep all intellectual property in your submission. You grant us a limited, non-exclusive licence to store, process and analyse it in order to provide the Service, and to display it on the Service where the submission is published.

7.Rejected, flagged and duplicate submissions

We may decline, flag or remove a submission that is incomplete, unintelligible, duplicated, fraudulent, unlawful or otherwise in breach of these terms. Where a submission is declined before processing begins and a fee was charged, clause 4 applies.

8.Availability

We aim to keep the Service available and accurate but do not guarantee uninterrupted access. We may suspend, change or withdraw features, including the processing fee, at any time.

9.Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with your submission or the Service is limited to the processing fee you actually paid for that submission. We are not liable for indirect or consequential losses, including lost profits, lost opportunities, lost funding or loss of data. Nothing in these terms limits liability that cannot be limited by law.

10.Privacy

We process the personal data you give us — your name where provided, email address, phone number, country and submission content — in order to run the assessment, contact you about it and meet our legal obligations. Submissions and reports may be reviewed by Dataluk staff. We do not sell your personal data.

11.Changes to these terms

We may update these terms. Each version carries a version identifier, shown at checkout and at the top of this page. The version you acknowledged at the time of payment is the version that governs that transaction.
